    Frequently Asked Questions for Disputes

    How does ZomWork.com qualify a dispute/report?

    Our customer personnel team, as a mediator, encourages all parties involved in a report/dispute to consider their commercial interests and aims to get both Client and Talent to agree to a compromise that will give both sides an acceptable outcome.


    If negotiations during the report/dispute mediated by ZomWork is successful and both parties agree to abide by the outcome, their acknowledgement to the agreement is considered legally binding.


    We would require the reporting party to fill in necessary information online here or email [email protected] with your concern. After submission, our customer personnel team will review the information and reach out to both parties in order to assess the severity of the report. If no answer/pick-ups happen over a 7 day period by you as the reporting party, we will consider the  situation as having been attended to at your own accord, and will cease to mediate on behalf as such.

    If all tried mediation via our personnel are not successful, or only partially successful, involved parties will be advised to settle outstanding issues through arbitration or litigation outside of the platform at their own accordance and cost, if incurred.

     

    With arbitration or litigation, both Client and Talent are bound by the decision/s issued by the arbitrator or judge, after both parties have considered all evidential submissions.

    If I lost the dispute, can I file for a reconsideration?


    Our customer service team takes careful consideration in the assesment of all disputes that arise and our decesion will be deemed as final when both parties are agreeable to the outcome we suggest and to abide by the decision. As such, no reconsideration will be taken into account.

    Is there a cut-off date to file a dispute after the project has been completed?



    All disputes for projects completed are encouraged to be submitted within 7 days from date of completion, up to a maximum of 14 days, otherwise it will be subject to special circumstances on a case by case basis and if the dispute is rejected we will notify the reporting party immediately.

    Is there a fee for dispute resolution?



    As an open communication platform, ZomWork encourages all it’s users to take a commercially responsible and reasonable initiative of their own to communicate with each other and resolve any dispute as a primary option. We do not take any fees for regular disputes submitted. However, if our customer service team is activated beyond the 14 day cut-off-date to file for a dispute and/or no resoultion is made during our mediation, we will be required to charge a one time fee of $30 to the reporting party, made payable to ZomWork.com for additional adminstration of manpower. This is an unwaivable charge.
